Division for Disputes concerning Foreign Investors operates within the Department for Commercial Matters within the Commercial Court, with jurisdiction over the entire the territory of Kosovo.
According to the Law on Foreign Investment, foreign investor means any foreign person who invests in Kosovo, whereas foreign person means any natural person who is citizen of a foreign country, any natural person who is citizen of the Republic of Kosovo, but resides abroad, a legal person established according to the law of a foreign country.
Foreign investment means any asset owned or otherwise legally held by a foreign person in the Republic of Kosovo with the aim of carrying out unlawful commercial activities, as set forth in this law.
Commercial Court of Kosovo – Division for Foreign Investments provides legal protection for any dispute or allegation arising out of or related to a foreign investment. Furthermore, the Division reviews and assesses the allegations of foreign investors for all the rights of a foreign investor related to the foreign investments in the Republic of Kosovo, not least when such rights are related to movable and immovable property, intellectual property and other assets, contracting right and rights deriving from this law.
All cases in this Division are reviewed and adjudicated by an individual judge.
All complaints against the decisions of the first instance chambers within the competences of the firs instance, which have been filed within the deadline set forth in the law, are reviewed and adjudicated by a panel composed of three judges in the Second Instance Chambers within the Commercial Court.
