According to the organizational structure of the courts of Kosovo defined in the Law No. 08/L-015 on Commercial Court, the Department for Commercial Matters that operates within the Commercial Court of Kosovo is the sole department that has the competence to handle the commercial/business matters from all over Kosovo.
Department for Commercial Matters of the Commercial Court is competent to handle:
Disputes between local and foreign business organizations, as well as disputes between public and private legal persons, related to mutual business issues and other issues between them; All legal remedies, as provided for in the law applicable to the enforcement procedure, for matters within the competence of this court;
Recognizing and allowing the enforcement of all local and international arbitration awards; Judicial disputes deriving from the applicable law concerning the business organizations; Reorganization, bankruptcy and dissolution of business organizations;
Protection of copyright and industrial property, including the trademark, patents, industrial designs, trade secrets and other forms of industrial property, as provided for in the relevant legislation;
Division for Disputes related to the foreign investors operates within the Department for Commercial Matters, with jurisdiction over the entire territory of Kosovo. Where necessary, the judges appointed in this Division will be engaged in other departments of the Court. As a general rule, all cases at the Department for Commercial Matters are handled by one (1) professional judge.
Department for Commercial Matters ensures that commercial disputes are resolved in the most efficient manner and that the business environment in Kosovo complies with the international norms and standards.
